Course objectives
This course will focus on Private international law, a body of rules used to resolve legal disputes between private individuals who cross international boundaries. Where a dispute is between two parties in different countries with different legal systems, private international law helps a court determine which country's substantive law will be used to decide the matter. This harmonization effort is designed to minimize the impact of international legal disputes and in so doing to promote international trade and commerce globally and also in the EU. Also called conflict of laws in labour and inheritance aspects. Private International Law or International Private Law governs the choice of law to apply when there are conflicts in the domestic law of different countries related to private transactions and also most important aspects of international business law. Those are the CISG aproach, importance of INCOTERMS, UNIDROIT and international transportation regulation. International relations are imbued with the dynamics that result from different sort of international negotiations, within which International Commercial Arbitration efforts are just one type of even more recurrent activities from the actors of the international system. The general goal of the course is to provide students with an overview of the theoretical and practical skills needed to engage in International Commercial Arbitration, at both the domestic and international level. The course guides the students through cutting edge debates within the field of International Commercial Arbitration and mediation in business and introduces them to the challenges of practical aspects of negotiation through in-class simulations.
