- The course is offered to students of any study field.
- Course objectives
- The aim of the course is to introduce to students the issues of private law, especially civil law. Within the course, the basic concepts of private law, its sources and principles are discussed. Attention is paid to the issue of legal personality and legal capacity, juridical acts and its interpretation, legal events, statute of limitations and negative prescription. The course is also focused on the issue of absolute rights and partly also relative rights, including obligations arising from torts and other legal reasons.
- Syllabus
- 1. Introduction to private law. Civil law and its place in the system of law, sources, principles of private law, terminology. Persons. natural persons, legal entities, the state. Legal personality, legal capacity, representation.
- 2. Juridical acts I. Juridical acts - conceptual signs, interpretation, defects of juridical acts. Legal events. Statute of limitations and negative prescription.
- 3. Rights in rem I. An asset, possession, ownership. co-ownership. Rights in re aliena. matrimonial property law.
- 4. Law of succession. Inheritance prerequisites. Measures taken for the case of death. The will and its interpretation. An inheritance contract. A devise. Legal consecution. Netting. An unforgettable heir. Transfer of estate to heirs. A confirmation of inheritance. Division of estate. Debts affecting the heirs.
- 5. Obligations I. Incurrence of liabilities, contract, contracting, common debts and receivables. Contracts concluded with the consumer.
- 6. Obligations II. Changes in liabilities, extinction of obligations, security interest and confirmation of debts.
- 7. Obligations arising from torts. prerequisites of the obligation to compensate for damages. compensation for property damage and detriment to health. circumstances excluding illegality. individual special facts of the obligation to compensate for damages. obligations for other legal reasons. the unjust enrichment.
- 8. Transfer of property ownership. Purchase, donation, exchange. Work contract. Work with tangible and intangible result.
- 9. Transfer of property to another person. Rent, usufructuary lease. Gratuitous loan terminable at will, loan for use, license, loan for consumption, credit. Purchase of a business enterprise, usufructuary lease of a business enterprise.
- 10. Payables resulting from contracts of mandate. Mandate, brokerage, committee, mail services, commercial representation.
- 11. Abuse and restriction of competition. Unfair competition, the elements of actus reus, protection against unfair competition and against restriction of competition.
- 12. Civil proceedings before a court. Basics of court proceedings. Complaint. Legal remedies.
